Size Status and Self-Certification

You have to obtain a written size self-certification from every subcontractor you count toward a goal. Most small vendors make you ask for it.

None of the codes NUUX is registered under turn on employee count, so the certification is straightforward to support.

Capacity, Insurance and Controls

The delivery-risk questions, answered before you have to ask them.

Capacity

Up to four concurrent fixed-price packages, or two concurrent engagements at simplified-acquisition scale. Capacity against your specific dates is confirmed in writing before any delivery date is accepted.

Insurance

Coverage is bound to the requirements of the engagement. Certificates naming the required limits and additional insureds are provided before a subcontract is signed.

Rates and Commercial Terms

You are pricing a bid on a deadline. A page that makes you email for rates costs you a day.

Rate card

Fully burdened not-to-exceed hourly rates by labor category, published below. No separate charge for overhead, G&A or travel within the continental United States unless agreed in writing.

Agreements NUUX will execute

Non-disclosure agreement, teaming agreement, and standard flow-down clauses. All three are already part of the standard NUUX agreement.

Contract type

Firm-fixed-price preferred, consistent with how commercial services are acquired. Time and materials considered where the prime’s vehicle requires it.

Intellectual property

Work product is created as work made for hire and transfers to the client on final payment. NUUX retains only a non-commercial portfolio right, which is waived where a contract restricts it.

Liability

Liability is capped at the fees paid under the statement of work in the three months preceding a claim, or the total project fee on a one-time project. Confidentiality breaches, indemnification and gross negligence sit outside the cap.

Change control

Each major phase includes two rounds of consolidated feedback. Work outside the approved scope proceeds on a written change order rather than absorbing silently.
