Agreement to these terms

These terms govern your use of nuuxstudios.com. By using the site you accept them. If you do not, please do not use the site.

These terms cover the website only. Work we do for clients is governed by a separate signed agreement, and where the two differ, that agreement wins.

Who we are

NUUX Studios is a design and growth studio registered at 800 N King St, Suite 304 #3190, Wilmington, DE 19801, United States. Throughout these terms “we”, “us” and “our” mean NUUX Studios, and “you” means anyone using the site.

Using this website

Use the site lawfully and do not interfere with it. That means no attempting to gain unauthorised access, no scraping at a scale that degrades service for anyone else, no introducing malicious code, and no using the site to send unsolicited commercial messages.

We may change, suspend or withdraw any part of the site without notice. We do not guarantee it will always be available.

Intellectual property

Everything on this site — the writing, design, code, photography, logo and the NUUX icon set — belongs to us or our licensors and is protected by copyright and trade mark law.

You may read it, and you may share a link or quote a short extract with attribution. You may not copy, republish or adapt any of it for commercial use without our written permission. Third-party brand marks shown on the site belong to their owners and appear only to refer to those companies.

Client work

Nothing on this site is an offer capable of acceptance. A project begins when both sides sign a proposal or statement of work, and that document sets the scope, fees, timelines, intellectual property and confidentiality terms for the engagement.

Case studies describe work we have done for named clients with their permission. Results shown are what happened for that client and are not a promise of what will happen for you.

Third-party links and services

The site links to other websites and embeds third-party services. We do not control them, we are not responsible for their content or their handling of your information, and a link is not an endorsement. Read their terms before relying on them.

No warranty

The site is provided as it is. To the extent the law allows, we make no warranties about its accuracy, completeness, availability, or fitness for any purpose. Articles and guides are general information, not professional advice, and should not be relied on as a substitute for advice about your own situation.

Limitation of liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill, arising from your use of the site. Our total liability for any claim relating to the site is limited to the greater of USD 100 or the amount you paid us in the twelve months before the claim.

Indemnity

You agree to cover us against claims, losses and reasonable legal costs arising from your misuse of the site or your breach of these terms.

Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

Governing law

These terms are governed by the laws of the State of Delaware, and the state and federal courts of Delaware have exclusive jurisdiction over any dispute. If any provision is found unenforceable, the rest continues to apply.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the site after a change means you accept the updated version.
